I William White of Nailsea in the County of Somerset Gentleman do make this my last Will and Testament in manner and form following that is to say I give and devise unto my brother James White all that my freehold messuage tenement lands and premises now in the occupation of George Withey situate in Nailsea aforesaid To hold to him my said brother and his assigns for and during so long time and term as any or either of my children living at the time of my decease or wherewith my said Wife shall be then Pregnant .... the age of twenty one years (subject nevertheless during such term or time to the payment of the annuity hereinafter given my Wife Isabella) And from and immediately after the youngest of my children living at the time of my decease or wherewith my said Wife shall be then Pregnant shall arrive to the age of twenty one years then I give and devise my said messuage lands and tenements in the occupation of the said George Withey unto and to the only proper use and behoof of all and every such my said child and children living at the time of my decease or wherewith my said Wife shall be then Pregnant To hold unto and to the use of such of my said children his her or their heirs and assigns as tenants in common and not as joint tenants for ever I give and devise All that my messuage or tenement lands and premises in Nailsea aforesaid now in my own occupation unto and to the use of my said brother his heirs and assigns Upon trust to permit my said Wife to reside in and occupy the same for and during her natural life if she shall so long continue my Widow and unmarried And from and after her discontinuing the occupation thereof or her marriage again which shall first happen I give and devise the same unto and to the use of all and every of my child and children as shall be living at the time of my decease or wherewith my said Wife shall be then pregnant equally to be divided between them share and share alike their heirs and assigns as tenants in common and not as joint tenants for ever I give and bequeath unto my said Wife and her assigns for and during the term of her natural life if she shall so long continue my Widow and unmarried and maintain and support my children until they respectively attain the age of twenty one years to the good liking and satisfaction of my said brother one annuity or clear yearly rent or sum of eighty pounds sterling money And in case of her neglect of maintaining my said children as aforesaid or marriage again and thereby the said eighty pounds annuity shall cease to be payable then I give her for and during the term of her natural life one annuity or yearly sum of twenty five pounds sterling money such annuity respectively to be paid her in half yearly payments at Lady day and Michaelmas day the first payment thereof to commence at the first of the said days which shall happen next after my decease And I do hereby expressly charge all and singular my freehold Estates hereinbefore devised to the Payment thereof And that the same be paid out of the rents and profits of my said ffreehold estates And in case of non payment of the said respective annuities on the days the same are hereby made payable Then I give full power of distress and re-entry on the premises charged therewith for the ...... thereof as is usual and customary for the recovery of rent in arrears I give and devise all my part share right title and interest of and in the Colliery and Coal Works at Nailsea aforesaid now carried out under the firm of James White and Co unto my said brother his executors administrators and assigns Upon trust to sell the same or otherwise to do therewith his will and pleasure for the benefit of the persons who may be entitled to my residuary personal Estate hereinafter bequeathed I give and bequeath unto my son Isaac my clock and case unto my son William my B...... And all the Rest of my household goods implements of household linen and china I give unto my said Wife I give all my silver plate unto and equally to be divided between my two sons Isaac and William share and share alike I give unto my friend James Rogers the sum of five pounds And all the Rest Residue and Remainder of my monies securities for money and all other my Personal Estate and Effects whatsoever and wheresoever and of what nature kind or sort soever not hereinbefore given and bequeathed I give and bequeath the same and every part thereof unto my said Brother James White his executors administrators and assigns Upon trust nevertheless to convert the whole thereof into money and thereout pay and discharge all my just debts legacy funeral expences and the expences of proving this my Will and the surplus thereof do and shall pay and divide the same unto and equally between all and every my said child and children as shall be living at the time of my decease or which my said Wife may be then pregnant share and share alike And it is my Will and I do hereby direct that my said brother his executors or administrators do lay out and invest either on ffreehold or government security the share or shares of such of my said child or children as shall be under the age of twenty one years during so long time and until he she or they shall attain the said age of twenty one years during so long time and until he she or they shall attain the said age and pay apply and dispose of the interest and proceeds to arise therefrom in the education clothing and advancement in the World shares of such of my said child or children respectively for and during so long time and until they shall respectively attain the said age of twenty one years and further that in case of the death of any one or more of my said children before attainment to the said age and without leaving issue of his her or their body or respective bodies lawfully begotten that the part or share of him her or them so dying as well original as accruing by survivorship of the said monies arising from my said Personal Estate and Effects and the unapplied interest and proceeds if any shall go to the survivors or survivor of such my said children equally to be divided between them share and share alike and to be paid to such surviving when and as they shall respectively be intitled to receive the original part or share thereof by virtue of this my Will And I hereby nominate and appoint my said brother James White sole Executor in trust of this my Will And I do hereby appoint my said Wife and my said brother Curators and Guardians of the persons and fortunes of my said child and children during their respective minorities until they arrive respectively to the age of twenty one years In Witness whereof I have to this my last Will and Testament contained on four sheets of paper to the three first sides thereof set my hand and to this fourth and last side my hand and seal this tenth day of May in the Year of our Lord one thousand eight hundred and thirty
